The below Terms of Business (“Terms”) are provided for your general information purposes only.
While we have used reasonable efforts to produce a set of Terms that are helpful to you, we make no representations, warranties, promises, conditions or other terms (whether express or implied) in relation to the Terms, including without limitation as to their completeness, accuracy, satisfactory quality or fitness for any purpose. Any reliance you place on the Terms and/or decision you take to use the Terms (whether in modified form or otherwise) is entirely at your own risk.
The Terms do not constitute technical, financial, or legal advice or any other type of advice and should not be relied on for any purpose.
Under no circumstances shall we be liable to you for any loss or damage suffered (including without limitation direct or indirect losses) arising from your use of, or reliance on, the Terms.
Should you proceed to use the below Terms, whether in modified form or otherwise, you will be deemed to have accepted the terms of this Disclaimer.

Terms of Business of Belper Gas & Heating
For the purposes of these Terms of Business (hereinafter, “Terms”), “us” or “we” shall refer to Belper Gas & Heating and “you” shall refer to you, our customer. You have requested that we undertake certain works for you and, by allowing us to proceed with those works, you are indicating your agreement to the Terms set out below.
1. Estimate
The value of the estimate is what we expect to charge you for the works, based on our initial discussions. In the event of unforeseen circumstances or unexpected issues arising, it may be necessary to review the original price and provide you with a new estimate. You have the right to accept or decline the revised price.
2. Written Quotation
The written quotation follows the estimate and is the final price for the works discussed, including labour and materials, additional costs including expenses (if any) and tax. Any subsequent variation to the works (including, without limitation, if you change the scope or if unforeseen circumstances or unexpected issues arise) will likely result in a new or revised written quotation. You have the right to accept or decline the new quotation. Should you choose to decline, all works will cease and, on receipt of our invoice, you must pay in full for all works already completed in accordance with the original quotation.
3. Client Obligations
(i) if you and we agree that you will be responsible for providing the measurements for some or all of the materials and/or products needed for the works, you alone will bear the cost of replacing the said materials and/or products in the event the measurements are incorrect;
(ii) if you and we agree that you will be responsible for providing some or all of the materials and/or products needed for the works, you alone will bear the cost of replacement in the event the said materials and/or products turn out to be faulty and/or unsuitable;
(iii) you will inform us, prior to the works commencing, of any hazards or potential hazards known or suspected in or around the premises where the works are due to be carried out;
(iv) you will grant us access to the premises where the works are to be carried out and will ensure that all necessary consents, permissions and licences, if any, have been obtained in advance of the works commencing;
(v) you will ensure the safe and secure storage of any materials and/or equipment left (with your permission) at the premises during the works, and will be accountable to us for any loss of or damage to such materials and/or equipment;
(vi) without prejudice to 4(i) and 4(iii) below, you will (unless included as part of the quotation) be responsible for any necessary improvements to and/or redecorating of the premises following the completion of the works.
4. Supplier Obligations
(i) we will undertake the works with all due care, skill and diligence, will complete the works within a reasonable timeframe, and will ensure that we comply at all times with all applicable laws and regulations;
(ii) we will supply materials and/or products needed for the works (if any) that are of high quality and, without prejudice to 3(i) above, will take full responsibility for replacing any materials and/or products that prove to be faulty or substandard;
(iii) we will take good care of your property, furnishings and wall coverings and, on completion of the works, will remove any resulting waste material;
(iv) we will supply one or more, as necessary, of our dedicated team to undertake the works for you. Unless agreed otherwise, the person(s) supplied will be at our discretion and may or may not be the same as the person(s) who provided you with the original estimate and/or quote;
(v) we confirm that we hold, and will continue to hold, a valid and current Public Liability Insurance Policy and, where relevant, Employers Liability Insurance Policy.
5. Materials and Products
For the avoidance of doubt, all materials and/or products supplied and delivered to you during the course of the works shall remain the property of Belper Gas & Heating until such time as the works have been paid for in full by you, following receipt of our invoice. Title to such materials and/or products will transfer to you only when full payment has been received by us.
6. Force Majeure
Neither party shall be held liable for any delay or failure in fulfilling their obligations under these Terms where such delay or failure results from circumstances beyond that party’s control (including, but not limited to, an act of God, fire, act of government or state, prevention from or hindrance in obtaining any raw materials, energy or other supplies, industrial action or labour disputes of whatever nature, and any other reason beyond the control of that party).
7. Cancellation
Should you wish to cancel the contract between us in respect of the works, you have (in accordance with the provisions of the Consumer Contract Regulations 2013) fourteen (14) days in which to do so following your acceptance of our quotation. You are obligated to pay for any services provided to you during this 14-day cancellation period, if any.
7a. Appliance service / breakdown or repair
i) Belper Gas and Heating Limited is not responsible for any cost for any defective parts or any parts that may come defective or faulty whilst carrying out the service gas inspection
Any service that is booked and not paid for online is to be paid for on the day of the service after completion. Payments are taken by cash, card or BACS (BACS must be paid with the engineer present)
ii) PLEASE NOTE:
If a service is cancelled with less than 24 hours' notice, or if the engineer is unable to gain access during the allocated booking time, the full cost of the service will be invoiced.
Please note that outstanding payments not settled within 30 days of the scheduled service date will be referred to our debt recovery partner, which may incur additional charges.

iii) Belper Gas And Heating Limited is not responsible for any service valves within the property that become defective whilst being used for their intended purpose. This includes but is not limited to, external and internal stop taps, isolation valves (pipework/boiler), drain-cocks, radiator valves and bleed/vent points. If these components become defective during use, we will advise and quote accodingly for a repair or replacement.
8. Payments
Full payment terms (including, where relevant, interval payments to be made by you) are as set out in the applicable quotation. For the avoidance of doubt, you agree to settle any undisputed invoice in full within 7 days of receipt unless otherwise stated.
9. Complaints
We hope and expect that you will have no cause to complain about any aspect of our service. If, however, there is anything at any point that does not meet your expectations, please do not hesitate to let us know and we will do our utmost to make things right.
10. Quotation and Pricing
This quotation is based on the work described within the Scope of Works and on the condition of the property and existing services that were reasonably visible or known at the time of quotation.
Any work requested by the customer that is outside the agreed Scope of Works will be treated as additional work and may result in additional charges.
Where additional work becomes necessary because of concealed defects, unsuitable existing installations, damaged pipework, structural issues or other circumstances that could not reasonably have been identified before work commenced, the customer will be advised before additional work is carried out wherever reasonably practicable.
Materials, Plumbing Parts and Fittings
Where stated within the quotation, material, plumbing part and fitting costs that cannot reasonably be confirmed in advance will be added to the quoted total when known.
The customer will be advised of any significant additional expenditure before the cost is incurred wherever reasonably practicable.
Goods specifically identified within the quotation as being supplied by the customer are not included within the Belper Home Improvements price.
Ownership of goods supplied by Belper Home Improvements remains with Belper Home Improvements until those goods have been paid for in full, subject to applicable law.
11. Deposit and Booking
A £500 deposit is required upon acceptance of the quotation to secure the agreed installation period and allow preparations for the work to commence.
If the customer subsequently cancels the work, Belper Home Improvements reserves the right to retain from the deposit an amount reasonably necessary to cover costs and losses directly incurred as a result of the cancellation, including specially ordered goods, administration, committed labour or other unavoidable costs.
Any remaining balance of the deposit will be refunded where applicable.
This does not affect any statutory cancellation rights the customer may have.
Cancellation Rights
Where statutory cancellation rights apply, including qualifying contracts entered into at the customer's home, online or otherwise away from Belper Home Improvements' business premises, the customer will be provided with the applicable cancellation information.
Where the customer expressly requests that work begins during any applicable statutory cancellation period, the customer may be required to pay for work carried out and goods or materials supplied before cancellation, to the extent permitted by law.
12. Payment
Unless otherwise agreed in writing:
The £500 deposit is payable upon acceptance of the quotation.
The remaining balance is payable on the day the agreed works are completed.
Payment can be made by Credit Card or Debit Card.
BACS payments may be made in person on the day of completion or for agreed goods purchased prior to commencement.
Payment by cheque is not accepted.
Receipts will be issued for all payments.
Where additional agreed work, materials, plumbing parts or fittings have been supplied during the project, these will be included within the final account.
13.Waste Removal
Where a skip or waste-removal service is included within the quotation, this will be clearly identified within the price.
If the customer chooses to arrange and dispose of their own waste, Belper Home Improvements must be informed before work commences so that the quotation can be adjusted where appropriate.
The customer is responsible for ensuring that any waste they elect to dispose of themselves is handled and disposed of lawfully.
14. Workmanship and Installation
Work undertaken by Belper Home Improvements will be carried out with reasonable care and skill and, where applicable, in accordance with relevant manufacturer's instructions and applicable Building Regulations.
Belper Home Improvements maintains appropriate business insurance.
Any workmanship guarantee provided by Belper Home Improvements applies to work and installations carried out by Belper Home Improvements and does not extend to pre-existing installations, pipework, fittings or components that have not been supplied or installed by us.
Nothing within these terms affects the customer's statutory rights.
Existing Pipework, Valves and Installations
Belper Home Improvements cannot guarantee existing pipework, fittings, joints, valves or components that were not installed by Belper Home Improvements.
Existing components may fail when operated, disturbed, isolated, drained, repressurised or otherwise used during legitimate installation, servicing or inspection work.
This includes, but is not limited to:
Internal and external stop taps
Isolation valves
Boiler valves
Drain cocks
Radiator valves
Bleed and vent points
Existing soldered joints
Existing compression fittings
Existing waste connections
Existing sanitary fittings
If an existing component becomes defective during legitimate use, the customer will be advised and any necessary repair or replacement will be quoted accordingly.
This exclusion does not apply where damage has resulted from negligence or a failure by Belper Home Improvements to exercise reasonable care and skill.
15. Changes from Low-Pressure to High-Pressure Systems
When upgrading an existing low-pressure or gravity-fed system to a mains-pressure or other higher-pressure system, previously satisfactory existing joints, fittings, valves or pipework may begin to leak or fail because they are being subjected to increased operating pressure.
Belper Home Improvements cannot accept responsibility for the failure of existing components solely as a consequence of the increased operating pressure, unless the failure results from work carried out without reasonable care and skill by Belper Home Improvements.
Any repairs subsequently required to existing components will be discussed and quoted separately.
Existing Components and Unforeseen Failures
Belper Home Improvements is not responsible for the cost of replacing existing components that independently fail or are found to be defective while legitimate servicing, inspection or installation work is taking place.
Where such a defect is discovered, the customer will be informed and any additional work required will be discussed before proceeding wherever reasonably practicable.
16. Access and Cosmetic Damage
Every reasonable effort will be made to minimise disturbance and cosmetic damage during installation.
Some work may necessarily require access through or removal of existing finishes or fittings, including:
Plaster or plasterboard
Boxing around pipework
Skirting boards
Ceiling coving
Joinery
Floor coverings
Kitchen cabinets
Plinths
Pelmets
Decorative finishes
17. Tiles and wall finishes
Where such disturbance is reasonably necessary to complete the agreed installation, making good, decorating or replacement is not included unless specifically stated within the Scope of Works.
Belper Home Improvements will not be responsible for unavoidable cosmetic damage reasonably necessary to carry out the agreed installation.
This does not exclude responsibility for damage caused by negligence or failure to exercise reasonable care and skill.
Customer-Supplied Goods
Where sanitaryware, tiles, flooring, showers, furniture, taps, fittings or other goods are supplied by the customer, responsibility for their suitability, condition, dimensions and availability remains with the customer unless otherwise agreed in writing.
Belper Home Improvements cannot accept responsibility for manufacturing defects, shortages, incorrect items or delays relating to customer-supplied goods.
Additional labour caused by defective, incorrect or unsuitable customer-supplied goods may be chargeable.
18. Variations and Additional Work
Any significant change to the agreed Scope of Works requested after acceptance of the quotation may alter the final price and completion time.
Where reasonably practicable, additional costs will be discussed with the customer before the additional work is undertaken.
Minor unforeseen works that are reasonably necessary to safely complete the agreed installation may be charged additionally where they could not reasonably have been identified before commencement.
19. Customer Communication
To maintain clear records and avoid instructions being missed or misunderstood, Belper Home Improvements does not conduct customer communication through WhatsApp groups, Messenger groups, SMS groups or other group-messaging conversations.
All customer communication relating to quotations, installations, changes to the Scope of Works, complaints, additional work or payment must be made directly between the customer and Belper Home Improvements through an agreed individual communication channel.
Where more than one person is involved in making decisions regarding a project, the customer should nominate one primary contact wherever possible. It is the customer's responsibility to ensure that information provided to that nominated contact is communicated to any other interested party.
Belper Home Improvements employees and subcontractors should not be added to customer-created messaging groups without prior agreement.
20. Working Hours and Messages
Customer messages, telephone calls and emails are dealt with during Belper Home Improvements' normal working hours, Monday to Friday, excluding Bank Holidays.
Messages received:
outside normal working hours;
during evenings;
at weekends;
on Bank Holidays; or
while staff are on annual leave or otherwise unavailable
will normally be dealt with during the next available working period.
Sending a message outside working hours does not create an obligation for Belper Home Improvements or its employees to respond outside working hours.
For genuine emergencies involving work recently carried out by Belper Home Improvements, the customer should use the emergency contact method provided where applicable.
Routine questions, design changes, complaints, appointment requests and project discussions are not regarded as emergency communications and will be dealt with during normal working hours.
21. Instructions and Decisions
Instructions affecting the price, specification, layout or Scope of Works should be confirmed directly with Belper Home Improvements.
Belper Home Improvements will not be responsible for conflicting instructions provided by different household members or third parties.
Where conflicting instructions are received, work may be paused until the customer or nominated primary contact confirms how they wish to proceed.
Any resulting delay may affect the completion date.
22. Delays
Reasonable efforts will be made to complete work within any estimated timescale given.
Completion dates may change because of circumstances outside the reasonable control of Belper Home Improvements, including material delays, unavailable parts, concealed defects, additional work, illness, adverse weather or delays caused by other trades or the customer.
The customer will be informed of significant delays wherever reasonably practicable.
23. Acceptance
By accepting this quotation, paying the requested deposit or instructing Belper Home Improvements to proceed, the customer confirms that they have had the opportunity to read and understand:

Any applicable cancellation information
and agrees to be bound by them, subject always to the customer's statutory rights.
